TERMS OF USE

Effective date: __ September 2026

These Terms of Use ("Terms") govern access to and use of coffeebeandevice.com (the "Site"), operated by Pavel Anatolyevich Yakimov ("we", "us", "our"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. About the Site
The Site provides information about the Coffee Bean device, including its concept, features, development status and potential production or collaboration opportunities. The Site may allow visitors to request information, submit contact details, express interest in prototype testing, discuss cooperation or request an NDA process.
2. Development-stage information
Coffee Bean may be in development and/or prototype stages. Images, renders, descriptions, specifications, features, configurations, production plans and timelines shown on the Site may be preliminary and may change.
Any development, manufacturing, launch or availability dates are estimates unless expressly stated otherwise. Market information, projections and commercial expectations are illustrative and do not guarantee any financial, investment or commercial outcome.
3. No offer; no automatic contract
Unless expressly stated otherwise, Site content is for informational and presentation purposes only and does not constitute a binding offer to sell, supply, manufacture, license, invest in or otherwise transact in relation to the Coffee Bean device.
Submitting a form, requesting testing, requesting an NDA or contacting us does not by itself create a contract, guarantee participation in testing, reserve a product, or oblige either party to enter into a transaction. Any binding relationship will be subject to separately agreed terms.
4. Prototype testing
We may decide whether prototype testing is available, who may participate, and the location, timing, format and conditions of testing. Additional terms, waivers, confidentiality obligations or other agreements may be required before participation.
5. Confidential information and NDAs
Certain technical, commercial, software, design, prototype or development information may be confidential. Access may be conditioned on execution of a separate non-disclosure agreement. A request to sign an NDA or receive restricted materials does not itself create an NDA or a right of access.
6. Intellectual property
Unless otherwise indicated, the Site and its content — including text, images, photographs, graphics, designs, diagrams, renders, videos, software elements, names, logos and technical materials — are owned by us or used with permission and are protected by applicable intellectual property laws.
You may view the Site for personal or internal business evaluation. Except where applicable law permits otherwise, you may not reproduce, distribute, modify, publish, commercially exploit, reverse engineer Site materials, or use technical or visual materials to develop a competing or derivative product without prior written permission from the relevant rights holder.
References on the Site to patents, patent applications or other intellectual property are informational and reflect the status known at the time of publication; they are not a warranty as to scope, validity, enforceability or future grant.
7. Acceptable use
You must not:
· interfere with or disrupt the Site, servers, networks or security measures;
· attempt to gain unauthorised access to restricted areas, systems, accounts or data;
· use automated means in a manner that imposes an unreasonable load on the Site;
· introduce malware or other harmful code;
· submit information you know to be false, unlawful or infringing;
· use Site content in violation of intellectual property, privacy or other rights;
· use the Site for unlawful, fraudulent or abusive purposes.
8. Third-party links and services
The Site may link to third-party websites, messengers, platforms or services. We do not control third-party services and are not responsible for their content, availability, security or privacy practices. Your use of them is governed by their own terms and policies.
9. Privacy
Our processing of personal information is described in the Privacy Policy. Cookies and similar technologies are addressed in the Cookie Policy. Where consent is required for a particular processing activity, it will be requested separately.
10. Disclaimers
To the maximum extent permitted by applicable law, the Site and its content are provided on an "as is" and "as available" basis. We do not warrant that the Site will always be available, uninterrupted, error-free, secure, or that all information will always be complete or current.
Nothing in these Terms excludes warranties, guarantees, consumer rights or other protections that cannot lawfully be excluded.
11. Limitation of liability
To the maximum extent permitted by applicable law, we will not be liable for indirect, incidental, special or consequential loss arising solely from use of, or inability to use, the informational Site. This limitation does not apply to liability that cannot legally be excluded or limited, including where applicable for fraud, wilful misconduct, death or personal injury caused by negligence, or mandatory consumer protections.
12. Changes and availability
We may change, suspend or discontinue Site content or functionality and may update these Terms. The current version will be posted on the Site. Material changes will be communicated where required by applicable law.
13. Governing law and mandatory local rights
These Terms are governed by the laws of the Russian Federation, without prejudice to mandatory rights and protections that apply to you under the laws of your country of residence and cannot lawfully be excluded by contract.
Any dispute will be handled by courts or other forums having jurisdiction under applicable law. Nothing in these Terms requires a consumer to waive a mandatory right to bring a claim before a competent authority or court in their place of residence where such right applies.
